1. Who We Are

Misselhorn Media (“we,” “our,” “us”) is a creative studio based in North Palm Beach, Florida, offering services including branding, logo design, graphic design, and web development (collectively, “Services”).

2. Services

We provide custom creative services based on the project scope agreed upon with you (“Client”). Services may include design, revisions, consulting, website creation, and related creative work.

3. Project Proposals and Agreements

Before starting any project, we will provide a proposal or contract detailing:

  • Scope of work
  • Deliverables
  • Timeline
  • Pricing and payment terms

By approving a proposal, you agree to pay for the Services and follow these Terms.

4. Payments

  • Deposit: Most projects require a non-refundable deposit to start work.
  • Final Payment: Remaining balance is due before final deliverables are sent.
  • Late Payments: Payments not received by the due date may result in paused work or additional fees.

We accept payment via methods listed in the project proposal.

5. Revisions & Approvals

  • Our proposals include a specific number of revisions. Additional revisions may incur extra charges.
  • Clients are responsible for providing clear feedback and approvals in a timely manner.
  • Once final deliverables are approved, the project is considered complete.

6. Ownership & Copyright

  • Pre-Final Work: All drafts, sketches, and unfinished work remain the property of Misselhorn Media until final payment is received.
  • Final Deliverables: Upon full payment, you receive ownership of the final approved designs for the intended use outlined in the agreement.
  • Portfolio Use: We may showcase your project in our portfolio or marketing materials unless you request otherwise in writing.

7. Client Responsibilities

  • Provide accurate, complete, and timely information for the project.
  • Respond to review requests within the agreed timeline.
  • Ensure you have the rights to any materials (logos, images, text) provided for use in the project.

8. Cancellations & Refunds

  • Deposits are non-refundable.
  • If a project is canceled after work has started, you may be billed for the work completed up to the cancellation date.
  • Refunds for completed work are not provided.

9. Website Use

  • By using our website, you agree not to use it for unlawful purposes or to interfere with its operation.
  • We may update the website or these Terms at any time. Continued use constitutes acceptance of the changes.

10. Disclaimers

  • While we strive for high-quality, error-free work, Misselhorn Media is not responsible for results beyond the scope of the agreed Services.
  • We do not provide legal, tax, or business advice unless explicitly stated in a project agreement.

11. Limitation of Liability

  • To the fullest extent allowed by Florida law, our liability for any claim related to Services is limited to the amount paid by the Client for that specific project.
  • Misselhorn Media is not liable for indirect, incidental, or consequential damages.

12. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes will be resolved in Palm Beach County courts.
